Information for data subjects

Humind Data Intelligence, a French simplified joint-stock company (SAS) registered with the Lyon Trade and Companies Register under number 817 579 923, whose registered office is at 26, rue Louis Loucheur, 69009 Lyon, France, acts as the data controller. Humind Data Intelligence publishes the IP Defender platform, used by intellectual property rights holders and their advisers.

• to identify offers, content, domain names and accounts that may infringe an intellectual property right;
• to create and investigate the corresponding case file, including preserving evidence;
• to send notifications, formal notices and amicable settlement proposals;
• to report disputed content to platforms, hosting providers, registrars and search engines;
• where applicable, to enable the rights holder to initiate legal proceedings.

The processing is based on legitimate interests (Article 6(1)(f) GDPR), consisting of defending the intellectual property rights of the relevant rights holder and protecting consumers against counterfeit products. A balancing assessment against your rights and freedoms has been carried out; a summary is available on request. You have the right to object (section 8).

• Identity and role: surname, first name and position within an organisation;
• Professional contact details: email address, telephone number and postal address;
• Published business information: listings, product pages, web pages, public accounts, prices and images used;
• Registration data: information from public company registers and domain-name registers;
• Case history: correspondence exchanged and subsequent action taken.

No special-category data within the meaning of Article 9 GDPR is collected.

• legal notices and contact pages of the websites concerned;
• public company registers and domain-name registration databases (WHOIS, RDAP);
• information provided by platforms pursuant to Article 30 of Regulation (EU) 2022/2065;
• information provided by the rights holder or by you.

• the relevant rights holder and its advisers, strictly within the scope of its own case;
• platforms, hosting providers, registrars and search engines receiving reports;
• technical service providers acting as processors for Humind Data Intelligence;
• competent courts, in the event of proceedings.

• Contact details: 24 months from the last relevant contact;
• Information from a case that is not pursued: 12 months;
• Closed case: 5 years from closure, corresponding to the limitation period for infringement actions;
• Case resulting in proceedings: for the duration of the proceedings, extended by 5 years after the final decision;
• Report dismissed or found to be unfounded: deletion or anonymisation within 30 days.

• Access: obtain confirmation of the processing and a copy of the data;
• Rectification: have inaccurate data corrected, in particular if you believe you have been wrongly identified;
• Erasure, under the conditions set out in Article 17 GDPR;
• Restriction, particularly while a challenge is being reviewed;
• Objection: object at any time to processing based on legitimate interests, on grounds relating to your particular situation;
• Data portability, where applicable;
• Instructions concerning your data after death, as provided for under French law.
